Film and sports representatives request exception from article 13

1 December 2018

A letter issued by members of the film industry (including IVF and MPAA) and sports leagues (including Premier League and DFL) requests the disapplication of the provisions of article 13 in their respective sectors. The letter states:

“… unfortunately the Value Gap [article 13] provision has mutated in such a way that it now strengthens even further the role of OCSSPs [online content sharing service providers] to the direct detriment of right holders and completely undermines the status quo in terms of the EU liability regime.”

Falling short of a return to existing jurisprudence of the CJEU (and initial Commission proposal), the signatories request that article 13 is limited to musical works and phonograms, to the exclusion of the film and sports sectors.
