New Bulgarian Presidency summarise Copyright Directive views

Following the issue of an “orientation debate” request, the new Bulgarian Presidency (having rotated from Estonian as of January 2018), have issued a further “discussion paper” based on guidance from COREPER. The earlier document indicated that the new Presidency aimed to retain articles 11 and 13, suggesting that Member States provide only comments as opposed to deletion. The discussion paper concludes similarly on both articles, holding that: a “genuine” ancillary right for press publishers’ is still feasible, and; filtering obligations are possible with amendment to e.g. limitations of liability.
