Leaked amendment proposals reveal support for stronger filtering obligations

A leaked document from the 27 April EU Council meeting indicates that France, Spain, Portugal, and Italy are in favour of introducing stronger content filtering obligations. Among the proposed amendments, the four countries suggest widening the scope of definition of OSP’s to include all companies whose primary purpose is to host content. Furthermore, the proposed amendments suggest that OSP’s will only be exempt from criminal liability where automated upload filters are implemented.

This follows an earlier leak with similar findings in October 2017, which indicated that France, Portugal, and Spain were in favour of introducing mandatory automated upload filters for OSP’s.
