Call for papers: Special Issue on Market Definition

The Journal of Antitrust Enforcement (OUP) has launched a call for papers on market definition. The selected papers will be published in a special issue or section of the Journal, with Magali Eben (CREATe) and Vicky Robertson  (WU Vienna) as guest editors.

Market definition is a central concept in competition law, which has been the subject of debate and challenge for decades. In recent years, there has been a resurgence in discussion about its role and utility, both in competition law generally and in digital markets specifically (which came to a head with the Digital Markets Act). In 2024, the soft law instruments on market definition were updated in both the EU and the US. It is against this background that this call for papers is launched.

Possible topics include, but are not limited to: the (new) purpose of market definition, markets and new types of economic power, broadening of the parameters of competition and its implications for markets, ecosystems market definition, innovation markets, and much more (see the call for papers attached for further suggestions).

Most of the debate on market definition has been focused on digital markets and comes from competition lawyers and economists. Yet, the debate would benefit from broader input and there is much to be said on market definition and intellectual property and markets in creative industries. We therefore invite anyone interested in the topic to submit an abstract.

To submit a proposal for a paper, please email us by 17 June 2024 with an abstract (max 300 words) that introduces the topic of your contribution, the approach or perspective you intend to adopt, and any potential conflict of interests. Please see the call for papers attached.

Authors of selected papers will be informed by 24 June 2024. Draft papers are due on 11 November 2024.

Authors of selected papers will be invited to attend a one-day workshop at The Competition Law Hub at WU Vienna on 20 November 2024 for an in-depth discussion of the draft papers ahead of publication, co-hosted by CREATe.
